Terms & Conditions
<p class=”has-text-align-center”>Reservations and Vacation Rental Agreements are subject to the following conditions and fees.</p>
<p><strong>1) Check-In</strong><br>Check-in time begins at 4:00pm (EST). Please stop by our office located at 2284 Saranac Avenue to pick up your keys and welcome packet. Please call for late arrivals after 5:00pm, we will be happy to provide instructions for picking up your check-in package at our office.</p>
<p><strong>2) Check-Out</strong><br>Check out time is 10:00am (EST). Sorry, no late check-outs allowed. Additional fees will apply.</p>
<p><strong>3) Reservation Deposit</strong><br>At the time of booking a payment of one-half of the total rent will be required to secure your reservation with us. We accept MasterCard, Visa and personal checks. If payment is being mailed in and not received within 10 days of booking, the reservation will be cancelled. Reservations made within 60 days of arrival will require a credit card and payment in full.</p>
<p><strong>4) Payment in Full</strong><br>Final payment for payment in full will be required 60 days prior to your arrival.</p>
<p><strong>5) Processing Fee</strong><br>A non-refundable $50.00 reservation processing fee for administrative costs will be charged to all reservations at the time of booking.</p>
<p><strong>6) Security Deposit</strong><br>Security deposit will be held in trust by Engel & Völkers and will be released within 20 days of departure. The security deposit may be used to satisfy any fees and conditions herein. Engel & Völkers may withhold any portion of the security deposit as it deems reasonable. In the event fees and conditions are not met and the security deposit is insufficient to compensate for the damages, Guests shall pay for any damage done to the premises over and above normal wear and tear. In addition, if the security deposit is paid by the Guest in the form of a personal check, Engel & Völkers will also require a Visa or MasterCard number from the Guest.</p>
<p><strong>7) Departure Check-out and Key Return</strong><br>Keys are to be returned to our office upon departure, with the exception of the Whiteface Lodge guests please check-out at the front desk of the resort. There will be a charge of $25.00 for each key not returned at check-out.</p>
<p><strong>8) Housekeeping</strong><br>Your vacation accommodations will be cleaned and inspected to quality standards prior to your arrival. Daily maid service or mid-stay cleans on the dates of your choice are available to you for an extra cost depending on the frequency, and size of the property. This service will be offered at the time of booking; however you can add this on at any time before or during your stay. Your accommodations will also be provided with a fully equipped kitchen and fresh bed linens and bathroom towels.</p>
<p><strong>9) Cleaning Fee</strong><br>Guests are required to pay a cleaning fee associated with the cost of cleaning the rental property on departure. The cleaning fee will vary by unit size and complexity. You will see this fee itemized on your vacation rental agreement separate from the rental rate. Guests are required to return furniture to original locations, load and run dishwasher and remove all food brought into the property and trash prior to departure. Failure to comply may result in additional cleaning fees.</p>
<p><strong>10) Waste Disposal</strong><br>Guests shall dispose of all waste material generated during the rental period in proper receptacles. Guest is cautioned not to leave trash outdoors because it attracts animals.</p>
<p><strong>11) Maintenance</strong><br>During your stay we request that you promptly report any maintenance issues to Engel & Völkers. Our staff will respond to your needs as soon as possible. No refunds will be provided due to inoperable appliances, hot tubs/pools or saunas. Owner will make every effort to assure appliances and said amenities are in good working order.</p>
<p><strong>12) Pets</strong><br>For the majority of our rental properties, pets of any kind are strictly prohibited. However there are properties that are designated as “pet friendly”. An additional pet fee will be required. Pet owners will be financially responsible for any damages and/or extra cleaning. Having a pet in a property that does not allow pets is grounds for immediate eviction without refund.</p>
<p><strong>13) No Smoking</strong><br>Smoking is not permitted in any Engel & Völkers Rental properties. Violations are subject to an additional charge of $500 plus the expense of any necessary cleaning. Violations may also results in immediate eviction and forfeiture of rent.</p>
<p><strong>14) Age Restriction</strong><br>Our properties will NOT be rented to vacationing students or young adults (under 21) unaccompanied by a responsible parent or guardian. A PARENT MUST BE STAYING IN THE UNIT AT ALL TIMES. OUR RENTAL UNITS ARE MONITORED FOR VIOLATION OF THIS POLICY. ALL VIOLATORS WILL BE EVICTED WITH ALL RENTAL PAYMENTS BEING FORFEITED AND ADDITIONAL CHARGES WILL BE APPLIED! RESERVATIONS MADE UNDER FALSE PRETENSES ARE NULL AND VOID AND CHECK-IN WILL NOT BE ALLOWED. This policy includes reservations made by parents who do not check in, and/or who leave overnight during the length of the stay. NO EXCEPTIONS!</p>
<p><strong>15) Maximum Occupancy (Group Size) & Events</strong><br>For the safety of all our guests, the maximum number of occupants is listed in the Agreement. Maximum Occupancy applies to “any given time”, no parties or gatherings (in excess of Maximum Occupancy) are permitted in our homes at anytime. In the event that Maximum Occupancy has been exceeded, occupancy may be terminated without a refund. We have select homes that allow events to be hosted in them. An event would be any gathering that is in excess of the stated Maximum Occupancy. For those homes that allow an event, an additional fee will apply. We reserve the right to refuse a rental, cancel an existing reservation or terminate occupancy (without refund) if the number of guests exceeds the stated Maximum Occupancy or we are of the opinion that your actions will be detrimental to the property.</p>
<p><strong>16) Security of Personal Property</strong><br>Engel & Völkers assumes no responsibility for any acts of theft or vandalism, or other damages to any personal property. This includes personal items left behind in the accommodation at departure. However we will put forth every effort to recover such items for you at your request. If personal items are left behind, we will ship them back to you via UPS Ground to your address. We will ask for your credit card details to pay for shipment.</p>
<p><strong>17) No Subletting</strong><br>Guest shall not sub-let or assign his/her rights under this Agreement in any manner. Your reservation is not transferable to any other party.</p>
<p><strong>18) Access to Property</strong><br>Guests shall permit Engel & Völkers and owner or his or her agents access to the property for purposes of repair and inspection. Engel & Völkers and owner shall exercise this right of access in a reasonable manner.</p>
<p><strong>19) Good Neighbor Policy</strong><br>Many of our rental properties are located in mix-use neighborhoods that include both short-term guests and year round residents. Please be sure to observe all rules and regulations, which are provided for each property. All guests, as well as owners, are required to conform to all rules and regulations of the properties. Violators are subject to eviction.</p>
<ul>
<li>Please abide by all noise, traffic, and refuse rules. Please also respect the rights and space of nearby homeowners and other rental guests.</li>
<li>Parking is allowed in your designated area ONLY. Some properties allow only two (2) vehicles, no boats, watercraft or RV’s. Specific properties do have vehicle registrations. Please inquire about allowed parking for your accommodations, especially if you are taking a multi-family vacation, traveling with leisure craft or will be parking more than two vehicles at your vacation residence at any time during your stay.</li>

<p><strong>20) Property Rules and Regulations</strong><br>Please remember that you are staying in someone’s home during your vacation. Please treat it with care as if it were your own. Please observe all rules and regulations governing the use of the property you are occupying. These rules apply to both owners and guests, and failure to comply can result in eviction.</p>
<p><strong>21) Damage Policy</strong><br>Guests are responsible for the property, its contents, and themselves during occupancy. Guests must lock windows and doors securely when not in the premises. Rearranging the furniture or removing any items from the unit is prohibited. After Check-Out, we will inspect the unit for damage, missing items, and abnormally dirty appearance. If we determine that damage is present, items are missing, or the unit is abnormally dirty, we will repair the damage, replace the missing items, and/or perform a deep clean of the unit at Guest’s expense. Guest authorizes us to charge the credit card on file under such circumstances.</p>
<p><strong>22) Disclosure & Indemnification</strong><br>Engel & Völkers represents the owner of the property in a client/agency relationship. GUEST ASSUMES ENTIRE RESPONSIBILITY AND LIABILITY FOR ANY CLAIMS OR ACTIONS BASED ON OR ARISING OUT OF INJURIES, INCLUDING DEATH, TO PERSONS, OR DAMAGES TO OR DESTRUCTION OF PROPERTY, SUSTAINED OR ALLEGED TO HAVE BEEN SUSTAINED IN CONNECTION WITH THE RENTAL OF PROPERTY OR THE PERFORMANCE OF THIS AGREEMENT BY ENGEL & VÖLKERS, ITS AGENTS AND EMPLOYEES, AND/OR THE OWNER OF PROPERTY, REGARDLESS OF WHETHER SUCH CLAIMS ARE BASED IN WHOLE OR IN PART, ON THE ALLEGED NEGLIGENCE OF ENGEL & VÖLKERS, ITS AGENTS AND EMPLOYEES, AND/OR THE OWNER OF PROPERTY. GUEST FURTHER AGREES TO INDEMNIFY AND HOLD HARMLESS ENGEL & VÖLKERS AND ITS REPRESENTATIVES, OWNER OF PROPERTY, AND THEIR RESPECTIVE AGENTS, INVITEES, AND LICENSEES WITH RESPECT TO SUCH MATTERS AND AGREES TO DEFEND ANY CLAIM OR ACTION BROUGHT AGAINST ENGEL & VÖLKERS, OWNER OF PROPERTY, OR REPRESENTATIVES, EMPLOYEES, AGENTS, INVITEES, AND LICENSEES THEREOF.</p>
<p><strong>22) Cancellation Policy</strong><br>There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions. If a Guest wishes to cancel his/her reservation, the Reservation Deposit will be refunded as follows:</p>
<p>$150.00 of the deposit is nonrefundable from the date of execution of this Agreement.<br>100% if cancelled 60 days prior to the Arrival Date, less $50 Processing Fee and $150.00 nonrefundable deposit.<br>0% if cancelled after 60 days prior to the Arrival Date.</p>
