Terms and Conditions
The following terms and conditions are part of this agreement and are agreed to by all parties hereto:
- SECURITY DEPOSIT. Security deposit will be held in trust by Agent and will be released within 20 days of departure, subject to the following conditions:
- Tenant leaves property in the same condition as received, normal wear & tear accepted.
- All keys have been returned to the Agent’s office located at 2284 Saranac Avenue, Lake Placid, and the Agent has conducted a satisfactory inspection of the dwellings inventory.
- No long-distance calls have been placed from the dwellings phone unless the calls have been placed to a 3rd party number or to the Renter's credit card.
In the event the above conditions are not met and the security deposit is insufficient to compensate for the damages, the RENTER shall pay AGENT whatever sum is necessary to do so. In addition, if the security deposit is paid by the RENTER in the form of a personal check, AGENT also requires that a Visa or Mastercard number from the RENTER.
- RULES. RENTER agrees by the rules and regulations governing the property. AGENT and OWNER shall not be liable for any bodily injury or property damage which may arise in connection with the RENTER’S occupancy of the dwelling. The RENTER agrees to indemnify and hold AGENT and OWNER harmless for any damages, injury, claim, or liability which may arise in connection with RENTER’s occupancy of the dwelling.
- PETS. Unless otherwise agreed to, no pets shall be permitted. Any violation of this provision will be considered a breech of contract. Tenancy will be immediately terminated.
- SUB-LET/ASSIGNMENT. RENTER shall not sub-let or assign his/her rights under this Agreement in any manner.
- SMOKING. It is agreed that there is no smoking in the dwelling or on the dwellings property.
- MAINTENANCE. If the RENTER encounters any problems with the dwelling’s plumbing, heating or electrical systems, or its appliances, RENTER must immediately report them to AGENT. If AGENT cannot timely remedy the problems, an appropriate adjustment in the rental payment will be negotiated with the homeowner and, if necessary, AGENT will use its best efforts to assist Renter in finding other accommodations.
- AGENCY. RENTER is herby notified that AGENT is the representative of the Owner and will receive compensation for services from the Owner.
- VIEWING OF PROPERTY. RENTER acknowledges that he/she is renting a privately owned home, which may be listed for sale. The property may be scheduled for viewing with interested clients, providing prior notice of said showing is made to the Renter.
9. CANCELLATION POLICY. $200.00 of the deposit is nonrefundable from the date of lease signing. If written notification of cancellation is received by Engel & Völkers Lake Placid Real Estate, Inc. at least 120 days prior to the start of the lease term, the reservation deposit will be refunded less the $200.00 nonrefundable fee. Any cancellation request made after 120 days will result in the forfeiture of the full deposit less cleaning, unless the property is re-rented for the term covered by this lease. In such event, the cancellation penalty shall be the $200.00 plus the shortfall (if any) between the rental consideration under this agreement and the amount for which the property is re-rented. |
